Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using HealthCommons (“the Platform”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you must not use the Platform.

2. Platform Purpose

HealthCommons is a purpose-built crowdfunding platform for vetted public health campaigns. Receivers (organizations) raise funds for specific, transparent health-related goals. Donors contribute to causes they wish to support. HealthCommons facilitates these transactions but is not a party to them.

3. Eligibility

  • You must be at least 18 years old to use the Platform.
  • Receivers must represent a legitimate organization or community initiative.
  • You agree to provide accurate and complete registration information.
  • You are responsible for maintaining the confidentiality of your account credentials.

4. Campaign Receivers — Responsibilities

  • All information submitted in a campaign — including goals, budget, and milestones — must be accurate and truthful.
  • Funds raised must be used solely for the stated campaign purpose. Misuse of funds may result in account suspension and legal action.
  • Nonprofits must provide a valid IRS 501(c)(3) determination letter. Other entities must accept tax compliance acknowledgments.
  • Receivers are responsible for their own tax obligations. HealthCommons does not provide tax advice.
  • All campaigns are subject to admin review before going live and may be suspended for compliance reasons.

5. Donors — Terms

  • Donations are voluntary contributions to causes you choose to support.
  • Once a campaign reaches its funding goal, donations become final and are no longer eligible for refund.
  • Refund requests are subject to a configurable time window (default: 7 days) from the donation date and require admin approval.
  • Stripe processing fees are non-refundable. Platform fees may be returned at HealthCommons’ discretion.

6. Platform Fees

HealthCommons charges a 5% platform fee on each donation. Stripe payment processing fees (currently 2.9% + $0.30 per transaction) also apply. Donors may opt to cover these fees so that the campaign receives the full intended amount.

7. Prohibited Conduct

You agree not to:

  • Submit false or misleading information about yourself or your campaign.
  • Use the Platform for any unlawful purpose, fraud, or money laundering.
  • Upload content that is defamatory, harassing, obscene, or infringes on others’ rights.
  • Attempt to circumvent platform fees or refund policies.
  • Use the Platform to collect personally identifiable information (PII) about donors.

8. Important Disclaimer — Not for PII or Sensitive Data

HealthCommons is not designed, intended, or warranted for the collection, processing, or storage of personally identifiable information (PII), protected health information (PHI), or any highly sensitive data. Receivers must not collect or display such information through campaign content, perspectives, or updates.

9. Limitation of Liability

HealthCommons provides the Platform “as is” without warranties of any kind. We are not responsible for the conduct of any user, the success or failure of any campaign, or any losses arising from your use of the Platform. To the maximum extent permitted by law, our total liability shall not exceed the platform fees you have paid in the preceding 12 months.

10. Account Suspension & Termination

We may suspend or terminate your account at any time, with or without notice, if you violate these Terms or for any other reason at our sole discretion. You may delete or deactivate your account at any time from your profile settings.

11. Modifications to These Terms

We may update these Terms periodically. Continued use of the Platform after changes constitutes acceptance of the revised Terms. Material changes will be communicated via email or in-app notice.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, USA. Any disputes shall be resolved through binding arbitration in accordance with applicable law.
